FinTrack Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FinTrack website ("Website") and FinTrack application ("Application"), collectively referred to as the "Service".

The Service is operated by Timures, a sole proprietor registered in Kazakhstan ("Timures", "we", "us", or "our").

By accessing or using the Service, or purchasing a FinTrack subscription, you agree to these Terms. If you do not agree with these Terms, you should not use the Service.

1. About FinTrack

FinTrack is a personal finance application designed to help users develop better financial habits and organize their personal finances.

The Application allows users to:

  • track income and expenses;
  • monitor savings and financial goals;
  • record recurring and essential payments;
  • account for financial obligations such as rent and taxes;
  • see how much money is available after planned or mandatory payments;
  • participate in financial challenges designed to encourage better financial habits.

FinTrack is a personal finance organization and tracking tool.

FinTrack does not provide investment, tax, accounting, legal, or other professional financial advice.

You are solely responsible for financial decisions you make based on information displayed by the Service.

2. Eligibility

You may use FinTrack only if you are legally capable of entering into a binding agreement under the laws applicable to you.

By using the Service, you confirm that you meet this requirement.

3. Account and Authentication

FinTrack uses Google Authentication for account authentication.

To use the Application, you must sign in using a supported Google account.

You are responsible for maintaining the security of your Google account and for all activity associated with your FinTrack account.

You must not allow another person to use your FinTrack account.

If you believe that your account has been accessed without authorization, you should contact us promptly.

4. Subscription

FinTrack is currently offered as a single paid subscription.

The current price is:

US $20 per month.

There is currently no free trial.

The subscription provides access to the FinTrack Application and its available features while the subscription remains active.

There are currently no separate Free, Pro, Premium, or other subscription tiers.

5. Automatic Renewal

Your FinTrack subscription automatically renews every month unless you cancel it before the next renewal date.

By purchasing a subscription, you authorize the applicable payment provider to charge the subscription fee on each renewal date until the subscription is cancelled.

The subscription price applicable to your purchase is displayed before you complete the transaction.

6. Payments

Payments and subscription transactions are processed by Lemon Squeezy.

Lemon Squeezy acts as the merchant of record for FinTrack transactions.

Payment information is processed by Lemon Squeezy rather than FinTrack.

FinTrack does not receive or store your complete credit card or debit card number.

Your purchase may also be subject to Lemon Squeezy's applicable terms and policies.

7. Cancellation

You may cancel your FinTrack subscription at any time.

Cancellation prevents future subscription renewals.

Unless otherwise required by applicable law or agreed by us, cancellation does not automatically result in a refund for the current billing period.

After cancellation, you may continue using FinTrack until the end of the period for which you have already paid.

Subscription management and cancellation may be available through the Lemon Squeezy customer portal.

8. Refunds

Refund requests are handled through Lemon Squeezy and are subject to applicable refund policies and consumer protection laws.

Nothing in these Terms limits any mandatory refund or consumer rights that apply to you under applicable law.

9. Your Financial Data

You retain ownership of the financial information and other content that you enter into FinTrack ("User Data").

You grant FinTrack a limited right to process and store User Data only as necessary to provide, maintain, secure, and operate the Service.

We do not claim ownership of your financial information.

You are responsible for the accuracy of the information you enter into FinTrack.

You should not enter financial information belonging to another person unless you have the legal right to do so.

10. Data Storage

FinTrack uses Google Firebase Firestore to store account and financial information.

Your financial information is stored in Firestore and is used to provide the functionality of the Application.

11. Acceptable Use

You agree not to:

  • use FinTrack for unlawful purposes;
  • attempt to gain unauthorized access to the Service or another user's account;
  • interfere with or disrupt the Service;
  • attempt to bypass security or authentication mechanisms;
  • reverse engineer, decompile, or attempt to extract source code from the Service, except where such restrictions are prohibited by applicable law;
  • use automated systems in a way that could damage, overload, or interfere with the Service;
  • introduce malicious software, code, or other harmful material;
  • abuse the Service or use it in a way that could negatively affect other users;
  • use FinTrack to store information that you do not have the right to use.

12. Intellectual Property

The Service, including its software, design, user interface, branding, logos, text, graphics, and other original materials, is owned by or licensed to Timures, a sole proprietor registered in Kazakhstan.

Your subscription gives you a limited, non-exclusive, non-transferable, revocable right to use the Application for its intended personal purpose while your subscription is active.

No ownership rights in the Service are transferred to you.

You may not copy, reproduce, modify, distribute, sell, sublicense, or commercially exploit the Service or its components without our prior written permission, except where permitted by applicable law.

13. Service Availability

We aim to keep FinTrack available and reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

The Service may occasionally be unavailable due to:

  • maintenance;
  • updates;
  • technical failures;
  • problems with third-party services;
  • security incidents;
  • circumstances outside our reasonable control.

We may modify, add, remove, or discontinue features of FinTrack as the Service evolves.

14. Third-Party Services

FinTrack relies on third-party services, including:

  • Google Authentication for user authentication;
  • Google Firebase Firestore for data storage;
  • Lemon Squeezy for subscription and payment processing.

Your use of third-party services may also be subject to their respective terms and policies.

We are not responsible for interruptions or failures caused solely by third-party services.

15. Financial Disclaimer

FinTrack is not a bank, financial institution, investment adviser, accountant, tax adviser, or financial planner.

The calculations, balances, challenges, reminders, and other information provided by FinTrack are intended to help you organize your personal finances.

They should not be considered professional financial, investment, tax, accounting, or legal advice.

FinTrack does not guarantee any particular financial outcome.

You are responsible for reviewing information displayed by the Application and making your own financial decisions.

16. Accuracy of Information

FinTrack relies on information entered by you.

We do not guarantee that information displayed by the Application will always be complete or accurate, particularly where the underlying information entered by you is incorrect or incomplete.

You should independently verify important financial information before relying on it for significant financial decisions.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • the Service will meet all of your requirements;
  • the Service will always be available;
  • the Service will be free from errors or interruptions;
  • information displayed by the Service will always be accurate or complete;
  • the Service will produce any particular financial result.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Timures, a sole proprietor registered in Kazakhstan will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

This includes losses arising from financial decisions made using information displayed by FinTrack.

To the maximum extent permitted by applicable law, our total liability arising from or relating to the Service will not exceed the amount you paid to FinTrack for the Service during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

19. Suspension and Termination

We may suspend or terminate your access to FinTrack if:

  • you materially violate these Terms;
  • you use the Service for unlawful purposes;
  • your actions create a security risk;
  • you attempt to compromise the Service or another user's account;
  • your subscription is cancelled or payment is not successfully completed, where applicable.

You may stop using FinTrack at any time.

If your account is terminated because you violated these Terms, you may lose access to the Service and your User Data, subject to our legal obligations and applicable data-retention requirements.

20. Account Deletion

You may request deletion of your FinTrack account by contacting:

support@fintrack.fyi

Your request should be sent from the email address associated with your FinTrack account.

Account deletion will result in deletion of your FinTrack financial data from our active systems, subject to information that we are legally required or permitted to retain.

Deleting your FinTrack account does not necessarily cancel your Lemon Squeezy subscription.

You should cancel your subscription separately.

21. Changes to the Service

FinTrack is an evolving product.

We may add, modify, suspend, or remove features from the Service.

We may also discontinue the Service in whole or in part.

If we discontinue a paid Service, we will handle any applicable refunds or other obligations in accordance with applicable law.

22. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will take reasonable steps to notify users where required by applicable law.

The updated Terms will be posted on this page with a revised "Last updated" date.

Your continued use of FinTrack after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

23. Governing Law

These Terms are governed by the laws of The Republic of Kazakhstan, without regard to its conflict-of-law rules.

Any disputes will be handled by the courts or other dispute-resolution mechanisms having jurisdiction under applicable law.

Nothing in this section limits mandatory consumer protection rights that may apply to you under the laws of your country or place of residence.
